WhatsApp Business API vs Unofficial Bots: The Risks

Is it legal to use a bot on WhatsApp Business?
Yes, on Meta's official WhatsApp Business Platform, also called the Cloud API. Meta built it precisely so that businesses can automate replies, send approved templates and let several people answer from one number. What Meta's terms forbid is automating a normal WhatsApp account through unofficial means: emulated phones, browser sessions kept alive by a script, modified apps. Those are treated as abuse, and the penalty is applied to the number, not to the software vendor.
What is the difference between WhatsApp Business App and the API?
The WhatsApp Business App is the free app on your phone. It is manual, tied to one device (plus linked devices), and has no way to plug in software. The API is a different product: your number is registered as a WhatsApp Business Account on Meta's servers, and messages are sent and received through Meta's Cloud API. That is what allows automation, a shared inbox for a team, and template messages sent to customers who have not written first. You access it either directly or through a provider, and Meta charges per conversation rather than per message.
How unofficial solutions actually connect
They pretend to be a phone. The tool opens a hidden WhatsApp Web session, keeps it alive around the clock, and reads and writes messages through it. That is why the setup always involves scanning a QR code with your phone. It works, until it doesn't: Meta's systems look for accounts that behave like scripts, sending at machine speed, at all hours, to many new contacts. When they flag one, the number is restricted and then permanently banned. The provider simply asks you to scan a new QR code with a new number.
What a permanent block costs a business
The number itself. It is the one printed on your shop front, saved in thousands of customers' phones, listed on Google Maps. There is no appeal process that reliably restores a banned personal number. On top of that, every conversation history and every contact that lived in that unofficial tool is gone with it.
What running on the official API changes
Meta-approved templates
Messages you send first, such as reminders and order updates, go through templates Meta has approved. It adds a step, but it is also what protects your sender rating: approved templates cannot be mistaken for spam.
Conversation-based pricing
Meta charges per 24-hour conversation, billed to your own Meta business account, with different rates for marketing, utility and service conversations. Customer-initiated service conversations are the cheapest by far, and in many cases free within the monthly allowance.
Your own Meta Business account
The WhatsApp Business Account belongs to your Meta Business portfolio, verified in your name. If you ever change software providers, the number and the account come with you. Meta's rules for AI on the platform also apply here: an agent is expected to stay within business tasks, identify itself when asked, and hand over to a human on request, which is how Agentaria's agent is configured by default.
How to check what your provider uses
Ask two questions. First, "Do you connect through the WhatsApp Cloud API, and will the WhatsApp Business Account be in my Meta Business Manager?" A serious provider says yes and shows you the embedded signup flow that Meta provides. Second, "Do I need to scan a QR code with my phone?" If the answer is yes, the connection is unofficial, whatever the sales page says.
